8. Your Rights (DPDP Act 2023)
As a data principal under the Digital Personal Data Protection Act 2023, you have the right to:

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client" or "User") and Global Hydraulic and Environmental Solutions ("GHES"), a scientific consulting and engineering firm registered in Pune, Maharashtra, India (GSTIN: 27AEWPR9790L1Z2), founded and led by Dr. Narasing Rao Ramesh.
By accessing ghes.in, submitting an enquiry, or engaging GHES for any service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use of our website and services immediately.
These Terms apply to all visitors, clients, prospective clients, sub-consultants, and any party that interacts with GHES through our website, email, phone, or in-person engagement.
2. Scope of Services

The precise scope, deliverables, timelines, and fees for any specific engagement shall be defined in a separate written Service Agreement or Work Order signed by both parties. These Terms apply in addition to, and do not replace, any such project-specific agreement.
3. Client Engagement & Responsibilities
A. Client Obligations
Provide accurate, complete, and timely information, data, and access necessary for GHES to perform the services.
Promptly review and provide feedback on deliverables within agreed timelines.
Ensure that all data provided to GHES is lawfully obtained and does not infringe any third-party rights.
Not engage GHES's personnel directly without prior written consent during the project and for 12 months thereafter.
B. GHES Obligations
Deliver services with professional skill, care, and technical excellence in line with industry standards.
Maintain confidentiality of all client data and project information (see Section 5).
Communicate project status and any material delays or issues in a timely manner.
Comply with applicable laws, regulations, and professional standards in performing the services.
4. Website Use & Acceptable Use Policy
By using ghes.in, you agree that you will not:
Attempt to gain unauthorised access to any part of the website, server, or database.
Upload or transmit malicious code, viruses, or harmful content.
Use automated scripts, bots, or scrapers to extract content from the website.
Submit false, misleading, or fraudulent information through any form or portal.
Impersonate GHES, Dr. Narasing Rao Ramesh, or any GHES employee or representative.
Use the website for any unlawful purpose or in violation of Indian law.

5. Intellectual Property & Confidentiality
A. Intellectual Property
All content on ghes.in — including text, graphics, logos, methodologies, mathematical models, reports, software, and technical documents — is the exclusive intellectual property of GHES or its licensors, protected under Indian copyright law (Copyright Act, 1957) and applicable international treaties. Reproduction, distribution, or commercial use without prior written authorisation from GHES is strictly prohibited.
B. Project Deliverables
Unless otherwise agreed in writing, all project deliverables (reports, models, data analyses, engineering drawings) produced by GHES remain the intellectual property of GHES until full payment is received. Upon receipt of full payment, the client is granted a non-exclusive, non-transferable licence to use the deliverables for the purpose stated in the project agreement.
C. Confidentiality
Both parties agree to maintain strict confidentiality over all proprietary information, technical data, business information, and project details exchanged during the engagement. This obligation survives the termination of the engagement for a period of 5 years.
Confidentiality obligations do not apply to information that is already in the public domain, independently developed, or required to be disclosed by law or court order.
6. Payment Terms & GST
Fees for services are as agreed in the project-specific Service Agreement or Work Order.
All invoices are subject to applicable Goods and Services Tax (GST) as per Indian tax law. GHES GSTIN: 27AEWPR9790L1Z2.
Payment is due within 30 days of invoice date unless otherwise stated in the project agreement.
GHES reserves the right to suspend services in case of overdue payments exceeding 15 days past the due date, after written notice.
Interest at 1.5% per month may be charged on amounts overdue beyond 30 days from the invoice date.
Out-of-pocket expenses (travel, site visits, third-party data procurement) will be invoiced separately unless included in the agreed fee.
7. Disclaimer of Warranties
GHES provides its website and consulting services on an "as is" and "as available" basis. While we strive for accuracy, completeness, and professional excellence, GHES makes no warranties — express or implied — including but not limited to:

That all website content is current, complete, or free from technical inaccuracies
That consulting outputs will guarantee specific commercial or regulatory outcomes
General information on this website is for informational purposes only and does not constitute formal engineering advice. Formal advice is provided only through executed project agreements.
8. Limitation of Liability
To the maximum extent permitted by applicable Indian law:
GHES shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of this website or the services provided.
GHES's total cumulative liability for any claim arising from a service engagement shall not exceed the total fees paid by the client for that specific project.
GHES is not liable for delays or failures caused by Force Majeure events including natural disasters, government actions, pandemics, or any circumstances beyond reasonable control.
Nothing in these Terms shall limit liability for death or personal injury caused by negligence, or any liability that cannot be excluded under applicable Indian law.
9. Termination
Either party may terminate a service engagement by providing 30 days' written notice, unless a different notice period is specified in the project agreement.
GHES may terminate immediately and without notice if the client breaches these Terms, fails to make payment, or engages in unlawful conduct.
Upon termination, the client shall pay all fees for services rendered up to the termination date, including work in progress.
Confidentiality, IP, and payment obligations survive termination of the agreement.
10. Changes to These Terms
GHES reserves the right to update or amend these Terms at any time. The "Effective Date" at the top of this document will reflect the date of the latest revision. For existing service engagements, any material changes to Terms will be communicated in writing and will not take effect until mutually agreed. Continued use of ghes.in after revised Terms are posted constitutes your acceptance.
11. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of India, including the Indian Contract Act, 1872, the Information Technology Act, 2000, and applicable GST legislation.
Dispute Resolution Process:
Step 1 — Negotiation: Parties shall first attempt to resolve any dispute through good-faith negotiation within 30 days of written notice of the dispute.
Step 2 — Arbitration: If unresolved, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Pune, Maharashtra.
Step 3 — Courts: For matters not subject to arbitration, the exclusive jurisdiction shall vest in the courts of Pune, Maharashtra, India.
